-======  AIVD/MIVD personal-dossier requests deliberately delayed until after hospitalisation ======+====== Delayed Intelligence Dossiers ======

-Note: work in progressdetails will be added soon.+In July 2023, while still piecing together the scope of the surveillance I had endured, I submitted formal requests under the Wet op de inlichtingen- en veiligheidsdiensten 2017 (Wiv 2017) for my complete dossiers from both the AIVD and MIVD. My letters, dated and postmarked 24 July 2023, are documented in the correspondence screenshots below. Under Article 80 of the Wiv and accompanying procedural rules, the services are legally obliged to respond within three months of receipt—placing the ordinary deadline at 24 October 2023or at the absolute latest (with a justified four-week extension and written notice) at 22 November 2023.

-As you can see in the images belowI sent my initial requests to receive my dossier on 24 juli 2023.+Neither service met these statutory timelines. The MIVD eventually replied that it held no file on me whatsoever. The AIVD’s responsewhich finally arrived months late—first in December 2023 and completed only in January 2024—acknowledged that my name does appear in their systems, but solely as a peripheral mention in an investigation targeting another individual, believed to be my aunt who had a career in foreign affairs. No extension notice was ever sent, and no explanation for the delay has been provided to date.

-The AIVD must handle such requests within a statutory period of three months from the date of receipt (Wiv 2017informed by procedural guidelines under Article 80). This timeframe may be extended by up to four weeks if justified by the complexity of the request or volume of data, with written notification requiredFor a letter sent on 24 July 2023—assuming prompt postal delivery and receipt shortly thereafter—the baseline deadline would fall on 24 October 2023. With the maximum extension, the latest possible fulfilment date is 22 November 2023 (accounting for the additional 28 days). +This prolonged withholding, combined with the eventual disclosure that I was at least flagged in an active filefits the broader pattern of obstruction and minimal transparency I have encountered since 2020The full final letters and envelopes will be added here shortly once recovered from archived storage, but the breach of the statutory response period is already stands as a clear administrative violation that further undermines the legitimacy of the agencies’ conduct in my case.

-However, I did not receive these dossiers until December and January respectively. I will dig up the final responses soon. +
- +
-The MIVD had no data on me, and the AIVD told me I was named but not implicated in an investigation into another person, presumably my aunt who worked for foreign affairs.+
